This article analyzes the technology of memory as truth, based on the work carried out by the Commission for the Clarification of Truth, Coexistence, and Non-Repetition, created in Colombia within the framework of the Peace Agreements signed by the government and the FARC-EP guerrillas in 2016, utilizing the confessional dispositif proposed by Michel Foucault in the 1970s and 1980s. The study of confession and testimony is developed in three stages: 1. The mechanism for collecting testimonies in the volume Cuando los (...) pájaros no cantaban will be analyzed. 2. The studies on confession and truth in Foucault's analyses will be revisited. 3. An articulation between memory and history based on testimonies is proposed. The article concludes with references to historical memory from the proposal of a testimonial technology, proposed from the confessional dispositif. (shrink)

ABSTRACT This article examines how Robert Owen’s ideas, and the example of his New Lanark Mill, were understood and received in Spain in the nineteenth century. It follows recent historiographic trends in the history of early Spanish socialism to show that although Owen’s ideas could not have a decisive impact in a largely agricultural economy and society, his ideas did draw more significant attention that has been thought. The article examines how Owen’s ideas, like those of Fourier and Saint-Simon, were (...) transmitted in Spain through different channels, in particular in education through the work of Pablo Montesino, and in the 1850s and 60s how they proved important to the creation of workers’ co-operatives in Valencia and Madrid. The article also explores how Owen’s ideas were important to the influential Spanish author Ramón de Sagra, and shows that the epistolary relationship between the two suggests that de Sagra might have been a more important voice for Owen’s ideas in Spain than has been appreciated. Jon Bing was not only a pioneer in the field of artificial intelligence and law and the legal regulation of technology. He was also an accomplished author of fiction, with an oeuvre spanning from short stories and novels to theatre plays and even an opera. As reality catches up with the imagination of science fiction writers who have anticipated a world shared by humans and non-human intelligences of their creation, some of the copyright issues he has discussed in his academic (...) capacity take on new resonance. How will we regulate copyright when robots are producers and consumers of art? This paper tries to give a sketch of the problem and hints at possible answers that are to a degree inspired by Bing’s academic and creative writing. (shrink)

According to the cohabitation account, all the persons that result from a fission event cohabit the same body prior to fission. This article concerns a problem for this account. Suppose Manuel and Jimena are suffering from an equally painful migraine. Unlike Jimena, however, Manuel will undergo fission. Assuming you have a spare painkiller, whom should you give it to? Intuitively, you have no more reason to give it to one or the other. The problem is that the cohabitation (...) account suggests otherwise. According to the account, there are two persons cohabiting Manuel’s body, in which case you should arguably give them the pill, since doing so alleviates the pain of more beings. One response argues that the two persons cohabiting Manuel’s body share one pain. Thus, giving them the pill alleviates no more pain than giving it to Jimena, and therefore you have no more reason to do one or the other. El objetivo fundamental del presente artículo es la configuración de una constelación de ficciones delirantes en la literatura latinoamericana contemporánea, a partir de la conceptualización del delirio literario y el análisis del proceso de construcción del relato delirante. Dado que, algunos narradores latinoamericanos despliegan ficciones delirantes en nuestros días, y existe un amplio número de casos, en donde el delirio se evidencia en la literatura de nuestro continente, autores como: Mario Bellatin, Roberto Bolaño, Rita Indiana Hernández, Horacio Castellanos Moya, (...) Cristina Rivera Garza, entre otros. Por consiguiente, se centrará la atención en la creación de una base crítica para la interpretación del delirio de algunos personajes de la literatura latinoamericana contemporánea, como un constructo cultural que transgrede el orden social, y es asumido como resistencia y articulación de una praxis creativa. Esta entrevista realizada al vicedirector de la Real Academia Española, José Manuel Sánchez Ron, busca resolver las inquietudes que se formulan a partir de las posibilidades de hallar una conjunción metodológica entre la Literatura y la Física. Para ello, se toma en cuenta la organización especializada de la RAE, que se encarga de la difusión y la preservación del buen uso del lenguaje y la creación literaria. El discurso, junto con las personalidades que se dedican a desarrollarlo, cumplen también (...) un rol importante para ello, ya que sirven como ejes para construir un lenguaje apropiado del castellano. Para terminar, este intercambio de conocimientos será de utilidad para desentrañar cómo se desenvuelve esta dicotomía de disciplinas en otros ámbitos, como el universitario. (shrink)

En este artículo describiremos la vitalidad del sistema fonológico del mapudungun hablado por escolares pewenches de la Provincia del Biobío, VIII Región. Específicamente, nos hemos propuesto: a) Determinar los fonos/fonemas, y su fonotaxis, que se relevan como indicadores de vitalidad, b) Identificar las transferencias fonético-fonológicas presentes en la fonología del pewenche hablado por estos escolares y c) Interpretar las transferencias encontradas en términos del grado de vitalidad de la fonología de la lengua. La muestra está conformada por un grupo de (...) 20 escolares bilingües de entre 12 y 15 años de edad, que se encuentran cursando 7° y 8° año básico en escuelas rurales pertenecientes a dos comunidades pewenches del valle del Queuco, en la comuna de Alto Biobío. Para la recolección del material fonológico, se aplicó a los participantes una lista léxica de 65 ítems, material que se complementó con la narración oral en mapudungun de un cuento. Según nuestros datos, hemos podido constatar la existencia de una serie de rasgos fónicos en el mapudungun hablado por los escolares pewenches que obedece a la influencia de las estructuras fonológicas del castellano. Sin embargo, el grado y la difusión de los fenómenos de transferencia se desarrollan de manera heterogénea en ambas comunidades en estudio, debido, entre otros factores, a la intensidad del contacto. In this article we will describe the vitality of the phonological system Mapudungun spoken by Pewenche schoolchildren from the Biobío province, VIII Region. We intend: a) To determine the phones/phonemes, and their phonotactics, which are revealed as vitality markers. b) To identify the phonetic-phonological transferences which are present in the Pewenche spoken by these schoolchildren, and, c) To interpret the transferences found in terms of the degree of the language phonological vitality. The sample is composed of 20 bilingual schoolchildren from 12 to 15 years old, who are in 7th and 8th grade in rural primary schools belonging to two Pehuenche comunities from Valle del Queuco, in the city of Alto Biobío. To collect the phonological material, we applied a 64-item lexical list, which was complemented with the oral narration of a tale in Mapudungun. According to our data, we have been able to verify the existence of a series of phonic features in the Mapudungun spoken by Pewenche schoolchildren, which originate because of the influence of the Spanish phonological structure. However, the degree and spread of the transference phenomena develop in a heterogeneous way in both of the studied communities. due to the contact intensity, among other possible factors. (shrink)

This article considers criticisms of this account that have been recently raised by John Doris, Victoria McGeer, and Michael Robinson. Robinson argues against Building Better Beings’s rejection of libertarianism about free will, and the account of desert at stake in the theory. considers methodological questions that arise (...) from the account of desert, providing some additional resources for thinking about these issues within the framework of the account. Both legal and moral theorists have offered broadly “communicative” theories of criminal and moral responsibility. According to such accounts, we can understand the nature of responsibility by appealing to the idea that responsibility practices are in some fundamental sense expressive, discursive, or communicative. In this essay, I consider a variety of issues in connections with this family of views, including its relationship to free will, the theory of exemptions, and potential alternatives to the communicative model. Focusing on Michael McKenna’s Conversation (...) and Responsibility, I argue that communicative accounts, and the conversational model in particular, direct our attention to important and under-appreciated elements of our responsibility practices. However, rather than focusing on a model of conversation-as-address, as McKenna does, we do better to regard gossip as the paradigmatic conversational form that captures the main features of moral responsibility. La intención de este artículo es proponer un término más adecuado para la nominación de las prácticas racistas y brindar una perspectiva analítica netamente relacional mediante la determinación y sistematización de las articulaciones intervinientes. Se trata de un trabajo de discusión teórica construido a partir de tres problemas, a saber: ¿cómo denominar un fenómeno social (racismo) que parte de una noción (razas humanas) carente de sustento biológico?, ¿qué relaciones comprende? y ¿a qué se debe su permanencia? Son tres las hipótesis (...) que los responden. En primer término, la contradicción enunciativa se resuelve introduciendo la expresión biologicismo. En segundo lugar, los relacionamientos que comprende son tres: el “técnico”, entre la dimensión física y las demás esferas humanas; el jerárquico, en función de las valoraciones diferenciales (mediante la dialéctica de las categorías norma-ideal/anomalía-degradante); y el instrumental, a partir de los intereses que propicia y encubre. Finalmente, la pervivencia se basa en tal instrumentalización por parte de las clases hegemónicas. Dos son los aportes. Por un lado, y desde una posición en alguna medida interdisciplinar, la justificación del uso de un concepto con mayor precisión. Y por el otro, el esclarecimiento de las relaciones acopladas intervinientes. Metodológicamente se procede examinando fuentes históricas y bibliografía sociológica y antropológica pertinente. For these reasons, the book can be used both for academic purposes, as a manual of philosophy of man or for personal enlightenment. Divided in five parts, the first part of the book works as an introduction, offering an overview of the human person and of the notion of person. The second part describes the internal structure of the human being addressing topics as corporeity as a personal fact; sensibility and the senses; affectivity; intelligence; freedom understood as choice and self-determination and, finally, the personal self. The third part analyses the person in action and some special types of action such as work and language. The fourth part deals with interpersonal relationships beginning with I-You relationship and following with the family and the social structure. El presente artículo ha sido pensado como un análisis introductorio que explora la presencia de Schopenhauer en la novela filosófica Rupertine del Fino del filósofo y literato alemán Philipp Mainländer, debido a la exigua investigación que se ha realizado al respecto y a la ineluctable influencia que desplegó el filósofo pesimista en la obra de Mainländer, asimismo, dicho análisis se entreteje con algunos puntos de la Filosofía de la redención de Mainländer. El esquema que se sigue es, primero, desarrollar una (...) reflexión en torno a la búsqueda de sentido, relacionando esto con las diferentes posiciones que asumen los personajes de la novela filosófica ante la vida, los modos en que se desenvuelven en el mundo, entre otros aspectos, centrándonos en el personaje de Rupertine con el propósito de entrever otros aspectos que no se limiten a presentarla simplemente como una mujer apasionada, puesto que nos proponemos resignificar y repensar al personaje. Por último, ahondar en las antípodas de estas filosofías, en las que la constatación de los avatares de la existencia humana y el desenvolvimiento del mundo son el referente principal de este análisis. This article explores how citizen participation was methodologically devised and materially articulated in the postdisaster reconstruction of Constitución, one of the most affected cities after the earthquake and tsunami that battered south central Chile in 2010. I argue that the techniques deployed to engineer the participation were arranged as a policy experiment where a particular type of public was provoked—one characterized by its emotional detachment, political engagement, and social tolerance. The case of Constitución, however, also shows that this public ran (...) parallel to other forms of being a public not aligned with the experiment’s assumptions. More broadly, the article argues that while disaster studies need to acknowledge the generative capacities of public participation, science and technology studies should include disasters as a particular setting for participatory experiments. The growing use of genetic tests in medical practice has a strong influence on some widespread notions of health and unhealth. Two consequences of this phenomenon are: (i) important changes in the meaning of these current notions and, therefore, (ii) the arrival of a new taxonomy or rearrangement for the so-called “health-concepts”. This paper attempts to demonstrate that both facts fuel a theoretical change that might be considered a model of scientific Kuhnean change in a fundamental aspect. On the other (...) hand, this theoretical shift process offers the basis for approaching a present-day controversy, i.e. whether Western society is going through a period of geneticization or not, from a new perspective. This chapter offers some insight into Spinoza's understanding of the concept of potentia. As is well known amongst scholars, the concept of potentia is fundamental for Spinoza. From ontology, to ethics and politics, the concept of potentia seems to embody the unity of Spinoza's thought. Unlike E1p9, Spinoza focuses on the independence or in the per se nature of the intelligibility of each attribute. The demonstration of the proposition recalls both the definition of the attribute and the definition of substance (...) as explanations. Having more reality, Spinoza states, means having more powers or strength, that is, more potentia to exist. The chapter shows that Spinoza's radical ontology of power emerges in the propositions preparing the consideration of God's necessary existence, namely E1p9–10. (shrink)

El cordobés Damián de Castro, gran exponente de la platería rococó española en la centuria dieciochesca, realizó junto a otros artífices diferentes piezas para el cardenal Delgado y Venegas, arzobispo hispalense entre 1776 y 1781. Hoy muchas de estas piezas las podemos contemplar en las vitrinas de nuestro museo catedralicio, sin embargo la existencia en su tiempo de diferentes piezas similares produjo cierta confusión en su posterior identificación. En este nuevo trabajo intentaremos desentrañar las dudas sobre dos de las más (...) vistosas piezas del tesoro de nuestro templo mayor: las dos bandejas de plata sobredorada que, ejecutadas en un exuberante y depurado rococó, deslumbran al visitante con sus fúlgidos destellos y atrevido diseño. En contra de una interpretación separatista, este artículo aboga por la existencia de una unidad entre la filosofía teórica y la filosofía práctica del bien en Aristóteles; al mismo tiempo, sugiere que su investigación se realice teniendo en cuenta la manera como se corresponden dos principios del pensamiento aristotélico: por un lado, el bien y la justicia no son cualidades necesarias , que es la tesis de los escritos teóricos; y, por otro, no hay manera de adquirir el bien para (...) el hombre, sino a través de la virtud, que es un hábito selectivo de lo bueno conforme a la razón –que es la tesis de los escritos prácticos. En el análisis de estos principios y su relación se descubre un tema más de fondo en la filosofía aristotélica: el concepto formal de bien es insuficiente para hacer bueno a un hombre, aunque no pueda ser suprimido en la explicación de su carácter moral. Against a separatist interpretation, this paper argues for the existence of a unity between Aristotle's theoretical and practical philosophy of goodness. At the same time, it suggests that this unity should be discovered in the correspondence of two principles: the goodness and justice are predicated according to more and less, which is the principle of his theoretical or logical writings and the principle saying that the only way to get a good end is through virtue, which is a selective habit of good things according to reason –which is the thesis of his practical treatises. The analysis of these two principles and their relations discovers a deeper issue in Aristotelian philosophy: the formal concept of goodness is insufficient to make good a man, although it cannot be suppressed in the explanation of the moral character of man. While applying general ethical principles and reasoning to the dilemmas presented by the development of nanotechnology is often useful and always legitimate, we also need to find a way to bridge the gap between general principles and the specific issues that arise from the development of individual nanotechnologies. Drawing inspiration from pragmatist thinking, a useful strategy is to focus on the links between the epistemological, political and social representations of a particular case. Using the example of a nanotechnological house, this (...) paper analyzes the problematic connections between scientific knowledge, technical expertise, decision-making and public engagement in nanotechnology representational networks. Saint Bonaventure did not write specifically on the natural law; nevertheless, interesting contributions on the issue can be derived from his theological reflection. The natural law, understood in the context of his doctrine of exemplarism, is a characterization of the interior experience, where “synderesis” appears as a fundamental faculty. Within this context, the Franciscan teacher derives a conception wherein the subject-object dialectic is overcome at several levels: epistemological, anthropological, metaphysical and moral.

El derecho a la privacidad está en el centro de muchos de los debates públicos actuales. Sin embargo, a pesar de la extensa literatura filosófica y jurídica sobre el tema, no contamos con una explicación adecuada del sentido y del valor de la privacidad. Esta falta de acuerdo sobre cuestiones conceptuales y normativas ha llevado a algún autor a hablar del ‘caos de la privacidad’. Este artículo se centra en la exploración conceptual de la privacidad. Para ello, en primer lugar, (...) consideraré cómo el derecho a la privacidad fue formulado por primera vez en el célebre artículo de Warren y Brandeis. Segundo, en la medida en que el derecho a la privacidad es sistemáticamente traducido en español como ‘derecho a la intimidad’, resulta crucial analizar con cuidado la confusa relación entre intimidad y privacidad. Con este fin, en las dos últimas secciones del trabajo discutiré algunas explicaciones de cómo trazar la distinción entre ambas nociones y cómo entender su intrincada relación. (shrink)

En este artículo se entremezclan las construcciones clásicas de la analogía con estructuras jurídico-positivas que se hacen hoy presentes en la interpretación y aplicación del derecho. El marco de referencia de estos vínculos no puede ser otro que el de una ontología de la relación. Una vez esclarecidas las diferentes elaboraciones doctrinales, se pretende justificar, en primer lugar, que la “analogía de proporcionalidad intrínseca”, cuyo origen se encuentra en la tradición tomista, constituye el fundamento filosófico de la “analogia iuris”, tal (...) como hoy se concibe esta figura en el ámbito de la Teoría del derecho. En segundo lugar, en este trabajo se sostiene que la “analogía de atribución intrínseca”, cuyo origen se encuentra en el genio creador del pensamiento de Suárez, constituye el fundamento filosófico de la analogía legis, tal como se encuentra actualmente regulada esta figura en el Código Civil español. La libertad ética debe descubrirse en el intersticio entre la libertad positiva y la negativa, considerándose como límite pero no limitada por éstas. En esa frontera tienen lugar los encuentros y los acuerdos entre los hombres libres, los cuales, más allá de la ley, pueden establecer relaciones justas. Por eso la ética es también un encuentro como lo es la política, entendida como vínculo entre la comunidad y la libertad moral de los individuos.
